Brands Forge Right provides digital marketing and performance marketing services including social media management, Meta ads management, lead generation campaigns, creative strategy, content creation, advertising creatives, campaign testing, optimization, and other related marketing services. Specific deliverables, timelines, and project requirements will be discussed and agreed upon before work begins.
A minimum upfront payment may be required before the commencement of services. Remaining balances must be paid according to the agreed payment schedule. Failure to make payments on time may result in delayed delivery, suspension of services, or termination of the engagement. All advertising budgets and platform spend are the sole responsibility of the Client and must be paid directly by the Client. The Agency is not responsible for platform charges, billing errors, payment gateway issues, or any costs incurred through advertising platforms. Payments made for completed work are non-refundable. No refunds will be issued for strategy work, partially completed projects, consumed service hours, or active campaigns.
The Client agrees to provide accurate business information, required assets, approvals, and account access necessary for project execution. The Client is responsible for responding within reasonable timelines to avoid delays and must ensure that all products, services, advertisements, and promotional materials comply with applicable laws and platform policies. The Agency shall not be held responsible for delays resulting from missing information, delayed approvals, restricted access, or incomplete client cooperation.
Marketing performance depends on numerous factors outside the Agency's direct control, including market demand, competition, product quality, pricing, offer structure, advertising budget, landing page quality, audience behavior, and sales processes. As a result, the Agency does not guarantee any specific number of sales, leads, revenue, return on ad spend, conversion rates, or business outcomes. Any projections, estimates, forecasts, recommendations, or suggestions provided by the Agency are intended for planning purposes only and do not constitute guarantees.
Final approved creatives, content, and deliverables provided to the Client may be used by the Client for their business purposes. Unless otherwise agreed in writing, the Agency retains the right to display completed work, campaign data, creative assets, and project outcomes in portfolios, case studies, presentations, marketing materials, and promotional content. Any work that remains unpaid shall remain the sole property of the Agency until full payment has been received.
The Agency shall not be liable for advertising account restrictions, account suspensions, platform bans, social media outages, policy enforcement actions, algorithm changes, third-party service interruptions, or losses resulting from business practices, platform decisions, or external circumstances beyond the Agency's control. The Client remains the sole owner and controller of all business accounts and related assets.
Official communication may take place through email, WhatsApp, scheduled calls, or any mutually agreed communication channel. Both parties agree to maintain professional, respectful, and timely communication throughout the engagement.
Either party may terminate the working relationship at any time by providing written notice. Upon termination, all outstanding invoices shall remain payable, active campaigns may be paused or removed, and the Agency shall have no obligation to continue providing support, management, consulting, or related services unless otherwise agreed in writing.
Both parties agree to keep confidential any non-public business information, data, strategies, documents, or materials shared during the engagement and shall not disclose such information to third parties unless required by law or authorized by the other party.
To the maximum extent permitted by law, Brands Forge Right shall not be liable for indirect damages, lost profits, business interruptions, loss of data, platform-related damages, or any consequential losses arising from the use of our services. The Client acknowledges that marketing activities involve inherent risks and that outcomes may vary based on factors beyond the Agency's control.
By proceeding with our services, submitting payment, approving campaigns, signing onboarding documents, or continuing engagement with the Agency, the Client confirms that they have read, understood, and accepted these Terms of Service.
